Which inheritance documents do I actually need?
Distinguish a will, probate, a succession certificate and local record changes.
Source snapshot: 5 September 2026. Check current requirements with the issuing authority.
Understand the issue
Documents serve different purposes. A succession certificate concerns debts and securities. Property title and mutation require their own assessment. Will registration is optional; execution and proof still matter. Section 213 was removed in 2025, so older blanket statements about compulsory probate need updating. There is no verified universal 5% inheritance-processing charge.
Prepare your next steps
Map the estate and the facts
List each asset, its owner, location, liabilities, nominees, heirs and any will or dispute.
Identify the receiving authority
Ask the bank, registrar, municipality or other institution for its current written checklist.
Match each request to its purpose
Have a lawyer distinguish heirship evidence, a succession certificate, probate or administration, title transfer and mutation.
Review the law and the costs
Ask about the 2025 amendment, applicable personal law and an itemised basis for each government or professional charge.
File through the confirmed route
Limit any authority you grant to the tasks required, retain receipts and acknowledgements, and verify the resulting records yourself.
Documents to prepare
- Death certificate and relevant family records
- Will and codicils, if any
- Asset titles, account details and nomination records kept securely
- Authority’s checklist and itemised fee estimate
Questions for your adviser
- What does this document establish for this particular asset?
- How does removal of Section 213 affect this estate or proceeding?
- Which requested NOC or charge has a statutory or institutional basis?
Watch for
“Every heir must obtain the same certificate” or “all inheritance costs are 100% avoidable.” Neither is a reliable universal rule.
Who can help
